FDA Enforces Regulation on Non-Tobacco Nicotine Products

The U.S. Food and Drug Administration (FDA) is actively enforcing a new federal law to regulate all nicotine products, including those from synthetic sources, to prevent manufacturers from avoiding FDA oversight.

Warning Letters Issued

The FDA has issued warning letters to two companies, AZ Swagg Sauce LLC and Electric Smoke Vapor House, for selling non-tobacco nicotine products without the required authorization and failing to submit premarket applications by the set deadline.

Retailer Compliance

In addition to targeting manufacturers, the FDA has sent 107 warning letters to retailers in two weeks for illegal sales of non-tobacco nicotine products to underage buyers, reinforcing the age limit of 21 for legal purchases.

Ongoing Enforcement

Director Brian King of the FDA's Center for Tobacco Products states that these actions are just the beginning of the FDA's compliance and enforcement strategy. The FDA is processing a substantial number of product applications and is prepared to take swift action against companies that do not comply with the regulations.

Public Health Commitment

The FDA's actions align with its commitment to protect public health and particularly to prevent the initiation of tobacco use among youth. The agency has invested in an educational campaign to highlight the risks of e-cigarette use to approximately 10.7 million youth.
